This website, deeperthancouture.com (the "Site"), is owned and operated by DEEPER THAN COUTURE LTD, a company duly incorporated under the laws of the Federal Republic of Nigeria with Corporate Affairs Commission registration number RC 1833768 and having its registered office at 8, IGBEI ROAD, AUCHI, EDO STATE, NIGERIA ("Deeper Than Couture", "we", "us", or "our").
Throughout the Site, these Terms of Service ("Terms"), together with our Privacy Policy, Shipping & Delivery Policy, and Luxury Return, Exchange & Refund Policy, govern your access to the Site and your purchase of any garments, accessories, archive pieces, or services ("Products") from us.
By visiting our Site or purchasing from us, you agree to be bound by these Terms. If you do not agree to all terms and conditions herein, you may not access the Site or use any of our services.
2. ONLINE STORE ELIGIBILITY & CONDUCT
By agreeing to these Terms, you represent that you are at least the age of majority in your country or state of residence, or that you have given us your consent to allow any of your minor dependents to use this Site under your supervision. You may not use our Products or Site for any illegal or unauthorized purpose, violate any laws in your jurisdiction (including intellectual property laws), or transmit any malicious code, bots, or automated scrapers designed to disrupt limited-edition capsule drops.
3. ORDER ACCEPTANCE, PRICING & CONTRACT FORMATION
• Invitation to Treat: Product listings on the Site constitute an invitation to treat, not a binding offer. When you place an order at checkout, your order acknowledgment email confirms receipt of your request only. A binding contract of sale is formed only when your Product has been quality-checked, dispatched, and confirmed via a shipping confirmation email.
• Right to Refuse or Cancel Orders: Deeper Than Couture reserves the sole right to limit quantities per person, household, or shipping address (particularly on limited capsule releases) and to refuse or cancel any order prior to dispatch—including cases involving stock unavailability, typographical or currency pricing errors, suspected reseller/bot activity, or payment verification flags raised by Paystack. If your payment has already been captured for a cancelled order, a full reversal will be initiated via Paystack.
• Multi-Currency Display: Prices displayed in foreign currencies via location-based session cookies are provided for browsing convenience. Final billing occurs in the currency displayed on the Paystack checkout screen at the time of payment authorization; your card issuer may apply its own foreign exchange conversion rates or international transaction fees.
4. PAYMENT PROCESSING & SECURITY (PAYSTACK)
Full payment is required prior to order dispatch. All online payments on deeperthancouture.com are processed securely through Paystack, a PCI-DSS Level 1 compliant payment processor supporting local and international debit/credit cards, bank transfers, USSD, and supported digital wallets.
• By submitting payment details, you warrant that you are an authorized user of the designated payment instrument.
• Deeper Than Couture maintains a strict zero-tolerance policy toward fraudulent chargebacks. Any unauthorized chargeback initiated after confirmed courier delivery via GIG Logistics or DHL Express will be contested with full waybill, IP, device, and delivery-confirmation records, and offending accounts will be permanently blacklisted.
5. SHIPPING, DELIVERY & RISK OF LOSS (GIG LOGISTICS & DHL EXPRESS)
• Order Processing: Standard ready-to-wear orders are processed, inspected, and packed within one (1) to three (3) Working Days (excluding weekends, Nigerian public holidays, and high-volume capsule launch periods).
• Domestic Shipping (Nigeria): Fulfilled primarily via GIG Logistics (GIGL) (or priority metropolitan riders where applicable). Estimated transit time after dispatch is 1–3 Working Days within major cities and 3–5 Working Days nationwide.
• International Shipping (Worldwide): Fulfilled via DHL Express. Estimated transit time after dispatch is 3–7 Working Days, subject to destination customs clearance.
• Tracking & Risk of Loss: Once dispatched, you will receive an automated tracking number via email/SMS. Please ensure your delivery address and active telephone number are accurate at checkout. Risk of loss and title to Products pass to you upon confirmed delivery to the shipping address provided on your order (or upon collection from a designated GIGL/DHL pickup point). Deeper Than Couture is not liable for stolen packages after confirmed courier delivery.
6. INTERNATIONAL CUSTOMS, DUTIES & IMPORT TAXES
Unless explicitly stated otherwise at checkout, all International Orders shipped via DHL Express are dispatched on a Delivered Duty Unpaid (DDU) basis.
• Product prices and shipping rates do not include destination country import duties, customs tariffs, brokerage fees, or local VAT/GST.
• As the importer of record, you are solely responsible for settling any duties or taxes requested by DHL Express or your local customs authority to release your shipment. Deeper Than Couture cannot undervalue commercial invoices or mark retail purchases as "Gifts," as doing so violates international customs law.
7. PRE-ORDERS, CAPSULE DROPS & MADE-TO-ORDER PIECES
Certain Deeper Than Couture collections may be offered on a Pre-Order or Made-to-Order basis. Estimated dispatch windows are indicated on the respective Product page and serve as good-faith production estimates. If your order combines both Ready-to-Ship and Pre-Order pieces, your entire order may ship together once the Pre-Order piece is complete unless separate shipping is arranged with our Client Concierge.
8. WHOLESALE & COMMERCIAL TRANSACTIONS
Unless governed by a separate executed Stockist Agreement, any approved wholesale or bulk commercial orders are final and non-returnable. Any manufacturing discrepancy on a commercial shipment must be reported in writing within forty-eight (48) hours of delivery with full photographic documentation.
9. ACCURACY OF GARMENT INFORMATION
We take extraordinary care to display the colors, textures, washes, and silhouettes of Deeper Than Couture garments accurately. However:
• Because digital monitors and mobile screens calibrate color differently, we cannot guarantee that your screen’s display of any shade will be 100% exact.
• Certain artisanal treatments—such as garment dyeing, acid/vintage washes, distressing, or hand-finished embroidery—are intentionally unique and may exhibit subtle variations from piece to piece. Such artisanal characteristics are hallmarks of luxury craftsmanship and do not constitute defects.
10. INTELLECTUAL PROPERTY & BRAND PROTECTION
All content on deeperthancouture.com—including the Deeper Than Couture name, emblems, monograms, garment designs, silhouettes, graphic prints, editorial photography, campaign videos, lookbooks, text, and website architecture—is the exclusive intellectual property of DEEPER THAN COUTURE LTD and its licensors, protected under the copyright, trademark, and industrial design laws of the Federal Republic of Nigeria and international treaties.
No portion of the Site or our Products may be reproduced, counterfeited, reverse-engineered, scraped, or exploited for any commercial purpose without our express prior written consent.
11. LIMITATION OF LIABILITY & FORCE MAJEURE
To the fullest extent permitted by applicable law, Deeper Than Couture shall only be liable for direct and reasonably foreseeable losses up to the total purchase price paid for the specific Product giving rise to a claim. We shall not be liable for any indirect, incidental, punitive, or consequential damages, or for delivery delays caused by events outside our reasonable control—including carrier network disruptions at GIG Logistics or DHL Express, customs inspections, severe weather, civil unrest, telecommunications outages, or force majeure events. Nothing in these Terms excludes or limits any statutory consumer rights that cannot lawfully be excluded under the Federal Competition and Consumer Protection Act (FCCPA).
12. INDEMNIFICATION & SEVERABILITY
You agree to indemnify, defend, and hold harmless DEEPER THAN COUTURE LTD, its directors, officers, employees, affiliates, and logistics/payment partners from any claim or demand (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or third-party rights. If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the severed portion shall not affect the validity of the remaining provisions.
13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms of Service and any separate agreements whereby we provide you Products or services shall be governed by and construed in accordance with the Laws of the Federal Republic of Nigeria.
In the event of any dispute or claim arising out of a transaction on the Site, both parties agree to first seek an amicable resolution in good faith by contacting our Client Concierge within fourteen (14) days. Where a dispute cannot be resolved amicably within thirty (30) days, it shall be referred to mediation or submitted to the exclusive jurisdiction of the courts of competent jurisdiction in the Federal Republic of Nigeria.
